Refund and cancellation

Cancelling, and getting money back. The items marked as your right are given to you by law: nothing on this page shortens one, and nothing asks you to sign one away.

Who this agreement is with

Ivan Krupa trading as Cereals MarketingAn individual trading under a business name in the United Kingdom. Not a company: there is no company number.36 Chatsworth Ave, Shanklin PO37 7NZcereals.marketinginfo@cereals.marketing

How to read the boxes

Every line below is one item of the checklist, and its status is the item itself, not a comment on it. Reading down the boxes tells you what sort of item each one is before you read a word of the wording.

  • Agreed5 itemsSettled in this contract. It applies to your order as written here.
  • Your right4 itemsThe law gives you this. Nothing on this site takes it away or shortens it.
  • Fixed wording2 itemsWording taken from legislation and reproduced rather than rewritten.
  1. Who this page is for

    Agreed

The items up to and including complaints are the rights of a consumer: someone buying for purposes wholly or mainly outside a trade, business, craft or profession. The item on business customers covers buying for a business.

What is being bought, and on what terms, is on the Terms page. When the report arrives is on the Delivery and service terms page.

  2. Model cancellation form

    Fixed wording

You may use this form, but you do not have to: any clear statement that you are cancelling will do just as well.

    Model cancellation form

To Ivan Krupa trading as Cereals Marketing, 36 Chatsworth Ave, Shanklin PO37 7NZ, info@cereals.marketing:

I/We [*] hereby give notice that I/We [*] cancel my/our [*] contract of sale of the following goods [*]/for the provision of the following service [*],

    Ordered on [*]/received on [*],

    Name of consumer(s),

    Address of consumer(s),

Signature of consumer(s) (only if this form is notified on paper),

    Date

    [*] Delete as appropriate.

Reproduced from Schedule 3 to the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, with the choices that Schedule leaves open filled in for a contract for services.

  3. If you asked for the review to start inside the 14 days

    Your right

Turnarounds here are short, and a review is bought with a launch date already in mind, so you may well want the work to begin at once. Asking for that does not cost you the right to cancel: the right runs for the whole 14 days, however much of the work has been done inside them.

What it changes is how much comes back. If you cancel after asking for the work to begin, you pay a proportion of the price reflecting what had been done by the time your cancellation reached me, and the rest is refunded. You are shown how that proportion was worked out.

Any statement that starting work waives the right to cancel a service would be wrong in law, and you will not find one on this site.

  4. Why you are never asked to give the right up

    Your right

Some websites ask you to tick a box agreeing that a digital file may be supplied at once and that you accept losing your right to cancel it. You are never asked that here, and no such box exists on this site.

The reason is what is being sold. This is a contract for a service: the review is the work, and the report is the account of it, not a file taken off a shelf. So the 14 days run their course, and the only thing that changes what comes back is how much of the work had been done when you cancelled, as the item above sets out.

If that ever changes - if something is sold here that is a ready-made file rather than a piece of work - the consent would have to be asked for separately, in a box never ticked in advance, with the loss spelled out beside it and confirmed back to you afterwards in writing. Until then there is nothing to tick and nothing to give up.

  5. How to cancel

    Agreed

Write to info@cereals.marketing, or by post to Ivan Krupa trading as Cereals Marketing, 36 Chatsworth Ave, Shanklin PO37 7NZ. Say that you are cancelling and give enough detail to identify the order.

A cancellation counts from when you send it, not from when it is read. A message sent on the fourteenth day is in time.

  6. How money comes back

    Agreed

Refunds are made within 14 days of the cancellation reaching me, by the same means of payment you used, unless you expressly agree to something else. No fee is charged for the refund and nothing is withheld as an administration charge.

Where a proportion is kept because work had already been done at your request, you are told what was done and how the figure was worked out.

  7. If the work is not right

    Your right

Under the Consumer Rights Act 2015 a service must be carried out with reasonable care and skill. If a review was not, you may ask for it to be performed again, and if that is impossible or is not done within a reasonable time, for a reduction in price.

The report, supplied as a digital file, must be of satisfactory quality, as described, and fit for a purpose you made known before buying. If it is not, you may be entitled to a repair or replacement, a price reduction, or a refund.

These rights apply whether or not the 14 days have passed, and they do not depend on cancelling anything. They last far longer than the cancellation period does.

  8. There is no "no refunds" rule here

    Your right

You will not find "all sales are final", "no refunds" or "digital purchases are non-refundable" anywhere on this site. Terms like those are not enforceable against a consumer and are not used here.

What is described above is your statutory position, and that includes the proportional refund: the Regulations require it, and it is not this business being generous with something it could have withheld. Where a term here does go beyond what the law requires, such as re-running free of charge a page or a check the report missed, it is in addition to your rights and never instead of them.

  9. Business customers

    Agreed

If you are buying for a business the 14-day statutory right to cancel does not apply to you. You may still cancel at any time by telling me in writing.

You then pay for the work done up to the point at which your cancellation reached me, and any balance already paid comes back within 14 days. Nothing is kept as a cancellation charge.

  10. Complaints

    Agreed

Complaints go to info@cereals.marketing or by post to Ivan Krupa trading as Cereals Marketing, 36 Chatsworth Ave, Shanklin PO37 7NZ. They are acknowledged within 5 working days and answered in full within 15 working days.

Complaining first costs you nothing: your right to cancel, your statutory rights and your right to take the matter further all stay exactly where they were.
